What You Need To Know AND DO AFTER A CAR ACCIDENT

Scales of Justice and Gavel

WHAT TO DO AFTER A CAR ACCIDENT

  1. Stay at the Scene:  Do NOT leave the scene of an accident unless you are taken away by an Ambulance or other medical professional.  In Alabama, there is a crime of “Leaving the Scene of an Accident” that you can be charged with if you leave an accident before the Police arrive (without being removed by medical professionals or due to injuries).
  2. Check for injuries: Check for injuries to yourself and others involved and then call the police.  The police will ask if there is any one injured and the Police will send an ambulance if anyone is hurt.
  3. Call the police: The police will create an accident report, take statements from witnesses, and document the conditions at the time of the crash. This is especially important if the other driver was intoxicated.
  4. Exchange Information with the Other Driver(s) If the situation is safe, exchange insurance and driver’s license information with the other driver.  It is easier to take pictures with your phone.  If the other driver is not going to stay, take a picture of the other car’s license plate and the other driver if possible.
  5. Limit conversation with the other driver: Limit your conversation with the other driver.  Do NOT admit fault. Just pass information to each other.
  6. Take pictures of the vehicles from all angles if possible:  To determine liability and the extent of the damage because of the crash, you need to take as many pictures as possible.
  7. Seek medical attention: See a doctor as soon as possible to get care and have your injury documented. This can be used as evidence in your case.
  8. Contact your insurance company: Report the accident to your insurance company as soon as possible and follow their procedures. Most insurance policies require you to file a claim within a reasonable time, usually a few weeks.
  9. Contact an attorney: A personal injury and accident lawyer can evaluate your case and advise you on your legal options and perhaps help you obtain compensation.
